In all the literature of the counterrevolution never do I see any works or reference to a great Supreme Court justice, Oliver Wendell Holmes, Jr.

Born in Boston in 1841, he grew up under the tutelage of his father, who had the same name and was a famous poet and physician. The younger was a graduate of Harvard, and he fought for the North during the U.S. Civil War. He left the Massachusetts Supreme Court and served as Associate Justice of the U.S. Supreme Court from 1902 to 1932. He was known as the Great Dissenter as he was usually in the minority on the Court.

Many fans of the Old Republic will find much to admire in Holmes. His jurisprudence was very favorable to states' rights, as he believed the federal government should not go beyond the strict wording of the Constitution. At the same time, he was an advocate of many of the economic policies in regards to trade and commerce that the U.S. would adopt under FDR. During his term on the bench his views might be described as economically progressive and socially conservative. He opposed the adoption of the 19th Amendment (women's suffrage) and would not favor the later misuse of the Constitution to create the current racially-integrated society. Overall, his ideology is essentially post-1865 and pre-20th century, pre-FDR, or pre-1960's, depending on the issue.

Holmes was a great intellectual; reading his works is always a pleasure, even if you are not a proponent of the Old Republic. I hope the following literature will spark some interest in the Honorable Justice:

Holmes was a smart man and an independent thinker, but always struck me as fundamentally nihilistic. It seems to me a counterrevolution would have to be based on something more substantive.
